Kentucky Court of Appeals says do not seize domains

Today a court of appeals judge ruled that Kentucky will not be allowed to seize the domain names used to gamble and play poker online. The Commonwealth of Kentucky was trying to seize the domain names of 141 companies by using a law that allows it to seize devices used to facilitate gambling.

“We are humbled by this decision and by the overwhelming support received from Internet businesses and free speech organizations everywhere,” said Jeff Ifrah, an attorney for a team representing the Interactive Gaming Council. “The Court of Appeals has now corrected a fundamental misunderstanding by the trial judge in this proceeding of the nature of the Internet and the legality of online poker in Kentucky.”

The Court of Appeals agreed with the domain owners attorneys that Kentucky does not have the jurisdiction to seize the domain names located outside its border. It did rule however that the domain names are indeed “gambling devices,” as defined by the law.

This ruling affects all of the websites that were targeted.

UPDATE:

The Kentucky Justice and Public Safety Cabinet appealed the decision and the case may now head to the Kentucky Supreme Court. A Notice of Appeal was officially filed on Wednesday.

Great way during a recession for a government body to spend money and resources. It beggars belief.

Still baffles me how individual states can effect the day to day life of all Americans. Hopefully the appeal is rejected swiftly and Kentucky poker players can get back to enjoying a pastime.

Man thats a bunch of BS, People need to realize the money that can be made from taxes on Poker and Weed, I dont even smoke weed but alot of people do
